TERMS AND CONDITIONS

1. Services

Cr8tive Venture LLC acts as an intermediary between clients and third-party providers (hotels, tour operators, transportation services, etc.) to organize travel and tourism experiences in Peru. The details of the contracted services will be specified in the booking confirmation sent to the client.

 

2. Reservations and payments

• To confirm a reservation, a partial or full payment is required as stipulated in the tour package.

• Payments may be made by bank transfer, credit/debit card, or other enabled methods.

• The remaining balance must be paid before the established deadline.

• Prices are subject to change based on availability and provider rates.

• Prices are quoted in the specified currency (USD, unless otherwise indicated) and only include what is explicitly detailed in the service description.

3. Client responsibilities

• It is the client’s responsibility to provide accurate information (names, dates, documentation) at the time of booking.

• Each traveler is responsible for having the necessary documentation (passport, visas, permits) for their trip.

• Clients are responsible for any required vaccinations and personal medications for their trip.

• The client must comply with the schedules of the contracted services and follow local regulations at the destinations visited.

4. Cancellations and refunds

In the event of a service cancellation, the following conditions apply:

• Cancellations and itinerary modifications must be submitted in writing; verbal cancellations will not be accepted. Cancellation and/or modification fees apply to all reservations, regardless of the reason, including academic, financial, or medical circumstances. If a cancellation or modification request is received 45 or more days before the trip’s departure date, Cr8tive Venture LLC will refund the trip deposit, minus any applicable supplier fees. Cancellations made between 45 and 15 days before the tour start date will incur a charge equal to 50% of the total trip cost, plus a cancellation and modification fee of US$375 per person, regardless of the reason. Cancellations and changes made within 14 days of the departure date are subject to a full loss of payment. Travel insurance is highly recommended.

• Refunds will be processed within up to 30 business days from the cancellation notice.

• No refunds will be issued for services not used during the trip due to the client’s decision.

• In the case of cancellation due to force majeure, rescheduling or credit toward a future booking may be considered.

 

5. Travel insurance

• Cr8tive Venture LLC strongly recommends purchasing travel insurance.

• Obtaining insurance is the sole responsibility of the traveler. The agency is not liable for expenses arising from unforeseen events such as illness, accidents, cancellations, lost luggage, or other events beyond our control.

6. Itinerary changes

• Cr8tive Venture LLC reserves the right to modify itineraries or services due to operational needs or force majeure, providing alternatives of equal or greater value when possible.

• Changes requested by the client are subject to availability and may incur additional costs.

7. Liability and limitation of liability

• Cr8tive Venture LLC acts as an intermediary between travelers and tourism service providers.

• Cr8tive Venture LLC is not responsible for delays, changes, or cancellations caused by third-party providers, weather conditions, or events beyond our control.

• We do not guarantee the performance of third-party services but will provide assistance to the best of our ability.

• Under no circumstances shall Cr8tive Venture LLC be liable for indirect, incidental, or consequential damages resulting from the use of our services.

8. Acceptance of risks

Certain activities (e.g., trekking, adventure sports) involve inherent risks. Clients participate at their own risk and must follow the instructions of the guides.

 

9. Personal data protection

All information provided by clients will be used solely for reservation management and will not be shared with third parties without prior consent, except when necessary to provide the service.

 

10. Intellectual property

All content on our website, social media, and promotional materials is the property of Cr8tive Venture LLC and may not be reproduced without prior written consent.

 

11. Governing law and dispute resolution

• These terms and conditions are governed by the laws of the State of Wyoming, USA.

• Any disputes will be resolved through arbitration in Wyoming in accordance with the rules of the American Arbitration Association (AAA).
